1. About These Terms

These Terms of Service govern access to and use of the Meubles Monaco website, marketplace and related services.

The website is operated by:

In these Terms, references to “Meubles Monaco”, “we”, “us” and “our” mean IFR Holdings Ltd trading as Meubles Monaco.

By accessing the Website, creating an account, submitting a listing, reserving or purchasing an Item, or otherwise using our Services, you agree to these Terms.

Please read them carefully before using the Website.

Nothing in these Terms affects any mandatory rights available to you under applicable consumer law.


2. Definitions

In these Terms:

Buyer means a User who reserves or purchases an Item listed on the Website.

Business User means a User acting for purposes relating to their trade, business, craft or profession.

Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession.

Item means any furniture, lighting, artwork, decorative object, furnishing or other product offered for sale through the Website.

Listing means the description, photographs, price and other information relating to an Item displayed on the Website.

Platform Fee means any listing fee, commission, reservation payment or other fee payable in connection with the Services.

Private Seller means a Seller who is not acting for purposes relating to a trade, business, craft or profession.

Professional Seller means a Seller acting for purposes relating to their trade, business, craft or profession.

Reservation Payment means the payment made by a Buyer to reserve an Item, normally €25 unless otherwise stated.

Sale Contract means the contract for the sale and purchase of an Item between the Seller and the Buyer.

Seller means a User who offers an Item for sale through the Website.

Services means the Website, listing, promotional, reservation, payment-facilitation, introduction and related marketplace services provided by Meubles Monaco.

User means any person or business accessing or using the Website or Services.

Website means meublesmonaco.com and any associated pages operated by us.


3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Services.

If you use the Services on behalf of a company, partnership or other organisation, you confirm that you have authority to bind that organisation to these Terms.

You must provide accurate, complete and current information when using the Website.

We may refuse access to the Services, suspend an account or cancel a transaction where we reasonably believe that a User:

  • has provided false or misleading information;

  • is acting unlawfully or fraudulently;

  • has breached these Terms;

  • presents a financial, reputational or compliance risk; or

  • has failed to cooperate with a reasonable verification request.


4. The Role of Meubles Monaco

Meubles Monaco operates an online marketplace connecting Buyers and Sellers of second-hand furniture and related Items, principally in Monaco and the South of France.

Unless expressly stated otherwise in a Listing:

  • Meubles Monaco is not the owner or Seller of the Item;

  • the Sale Contract is concluded directly between the Buyer and the Seller;

  • Meubles Monaco is not a party to the Sale Contract;

  • the Seller is responsible for the Item, its description, ownership, condition and availability; and

  • the Buyer is responsible for assessing the suitability and condition of the Item before completing the purchase.

Our role may include:

  • preparing and publishing Listings;

  • marketing Items;

  • introducing Buyers and Sellers;

  • facilitating reservations and payments;

  • sharing contact or collection information;

  • assisting communications between the parties; and

  • providing reasonable assistance if a dispute arises.

Unless expressly agreed in writing, we do not:

  • take ownership or possession of Items;

  • warehouse or store Items;

  • provide removal or transport services;

  • guarantee that an Item will sell;

  • authenticate or professionally value Items;

  • conduct a structural or technical inspection; or

  • guarantee the conduct of any Buyer, Seller or third-party service provider.

Nothing in these Terms prevents us from selling an Item directly where a Listing expressly identifies Meubles Monaco or IFR Holdings Ltd as the Seller. In that situation, the terms applicable to a direct business-to-consumer sale will apply.


5. Private and Professional Sellers

Each Seller must accurately state whether they are acting as:

  • a Private Seller; or

  • a Professional Seller.

We may request evidence of a Seller’s identity, business status or authority to sell.

Professional Sellers are responsible for complying with all laws applicable to their sales, including any requirements concerning:

  • pre-contractual information;

  • consumer withdrawal or cancellation rights;

  • legal guarantees;

  • product safety;

  • invoices and taxation;

  • business identification;

  • dispute-resolution information; and

  • after-sales obligations.

Where a Professional Seller sells to a Consumer, mandatory consumer rights may apply even where an Item is second-hand.

Sales by Private Sellers may be subject to different legal rules. Buyers should therefore check the status of the Seller displayed in the Listing before completing a purchase.

Meubles Monaco does not determine or provide legal advice on the rights arising under an individual Sale Contract.


6. User Accounts and Information

You may be required to create an account or provide personal and contact information to use certain Services.

You agree to:

  • provide accurate and complete information;

  • keep your information updated;

  • maintain the confidentiality of your login details;

  • notify us promptly of unauthorised account use; and

  • remain responsible for activity carried out through your account.

You must not create an account using another person’s identity or impersonate another individual or organisation.

Our handling of personal information is described in our Privacy Policy.


7. Listings

Listings may be prepared using information and photographs supplied by the Seller.

The Seller is responsible for ensuring that all Listing information is accurate, complete and not misleading.

Each Seller must disclose, so far as reasonably known:

  • the Item’s brand or manufacturer;

  • dimensions;

  • materials;

  • approximate age or date;

  • location;

  • condition;

  • significant wear, damage, repairs or alterations;

  • missing parts;

  • whether assembly or specialist removal may be required;

  • whether the Item is an original, reproduction or attributed piece; and

  • any other information that could reasonably influence a Buyer’s decision.

Minor variations in colour may occur because of photography, lighting and screen settings.

Descriptions such as “vintage”, “antique”, “attributed to”, “in the style of” or similar expressions may involve opinion rather than a guarantee of age, origin or authorship.

Unless we expressly confirm otherwise in writing, Meubles Monaco does not independently verify the accuracy of a Listing.

We may edit a Listing for spelling, presentation, consistency or marketing purposes. This does not transfer responsibility for the Listing’s substantive accuracy from the Seller to us.


8. Listing Approval and Removal

We may approve, reject, edit, suspend or remove any Listing at our discretion where reasonably necessary.

We may take such action where, for example:

  • the information is incomplete or inaccurate;

  • the photographs are unsuitable;

  • the Item falls outside the scope or quality of the marketplace;

  • the proposed price appears misleading;

  • the Item may be unlawful, unsafe, counterfeit or subject to third-party rights;

  • the Seller has breached these Terms; or

  • continued publication could expose us or another person to legal or reputational risk.

Publication of a Listing does not amount to an endorsement, valuation, authentication or guarantee by Meubles Monaco.


9. Prohibited Items and Conduct

Users must not list, reserve, purchase or attempt to sell:

  • stolen goods;

  • counterfeit goods;

  • Items they do not own or have authority to sell;

  • Items subject to finance, liens or third-party claims;

  • unlawful or restricted goods;

  • hazardous materials;

  • Items that present an undisclosed health or safety risk;

  • Items derived from protected species where sale is prohibited or required documentation is unavailable; or

  • any Item whose sale would breach sanctions, export controls, customs rules or other applicable law.

Users must not:

  • engage in fraud, deception or money laundering;

  • manipulate prices or Listings;

  • submit false reviews or information;

  • misuse another User’s personal information;

  • interfere with the Website’s operation;

  • introduce viruses or malicious code;

  • scrape or reproduce Website content without permission;

  • use the platform to send unsolicited marketing;

  • harass, threaten or abuse another User; or

  • circumvent Meubles Monaco to avoid fees.

Users should report potentially unlawful or misleading Listings to info@meublesmonaco.com.


10. Listing Fees

A non-refundable listing fee of €25 normally applies to the listing of up to three Items, unless a different arrangement is agreed in writing.

The listing fee covers the preparation, administration and publication of the Listing. It does not guarantee:

  • acceptance of every proposed Item;

  • a particular publication period;

  • enquiries;

  • a reservation; or

  • a completed sale.

The listing fee becomes non-refundable once we have begun preparing or publishing the Listing, subject to any mandatory cancellation rights that apply to the Seller’s purchase of our listing service.

Where a Consumer asks us to begin providing a paid listing service during an applicable cancellation period, we may ask for their express request and acknowledgement before commencing the service.


11. Pricing and Commission

The Seller agrees with Meubles Monaco the amount the Seller wishes to receive for the Item, referred to as the Seller Price.

Unless otherwise agreed, Meubles Monaco adds a commission of 15% to the Seller Price. The resulting total is the price displayed to the Buyer on the Website.

The displayed price therefore includes Meubles Monaco’s commission but does not include any separately stated transport, installation, customs, banking or third-party charges.

For example, if the agreed Seller Price is €1,000, the displayed Buyer price would normally be €1,150.

The commission becomes payable where an Item is sold to a Buyer introduced through Meubles Monaco.

A Buyer is treated as having been introduced through Meubles Monaco where the Buyer:

  • viewed or enquired about the Listing through the Website;

  • contacted the Seller following information supplied by us;

  • attended a viewing arranged through us;

  • made a Reservation Payment; or

  • was otherwise connected with the Seller through our Services.

The commission remains payable if the Buyer and Seller complete the transaction directly or outside the Website within six months of the introduction.

All prices and fees are stated in euros unless otherwise indicated.

Any applicable taxes will be included or added as required by law.


12. Reservations

A Buyer may be required to pay a Reservation Payment, normally €25, to reserve an Item.

Unless otherwise stated:

  • the Reservation Payment is credited towards the total purchase price if the sale completes;

  • the Item may be marked as reserved for a limited period;

  • the Buyer must respond promptly and cooperate in arranging inspection, payment and collection;

  • the Reservation Payment does not transfer ownership of the Item; and

  • a reservation remains subject to confirmation that the Item is still available.

The Reservation Payment may be retained where the Buyer:

  • changes their mind without a legally recognised right to cancel;

  • fails to respond or proceed within the agreed period;

  • does not attend an agreed viewing or collection;

  • refuses the Item for reasons already clearly disclosed in the Listing; or

  • otherwise fails to complete the purchase without valid grounds.

The Reservation Payment will normally be refunded where:

  • the Item is no longer available;

  • the Seller withdraws from the transaction;

  • the Listing materially misrepresented the Item;

  • the Item is materially different from the Listing; or

  • a mandatory legal cancellation or refund right applies.

Refunds are returned using the original payment method where reasonably possible.


13. Orders and Formation of the Sale Contract

A Listing is an invitation to make an offer and does not oblige the Seller to accept a purchase.

A Buyer makes an offer to purchase when they complete the required checkout or reservation process.

The Sale Contract is formed between the Buyer and Seller when the purchase is confirmed by or on behalf of the Seller, or when another point of contract formation is expressly stated during checkout.

Meubles Monaco may cancel or reverse an Order before completion where:

  • the Item is unavailable;

  • the price or Listing contains an obvious error;

  • payment is not authorised;

  • identity or compliance checks cannot be completed;

  • fraud or unlawful activity is suspected;

  • the Buyer or Seller has breached these Terms; or

  • cancellation is otherwise reasonably necessary.

Where we cancel an Order and no party is entitled to retain the money, amounts paid through the Website will be refunded.


14. Payment

Buyers must pay the full purchase price using the payment method and within the timeframe stated during the transaction.

Payment may be processed by a third-party payment provider. The payment provider’s separate terms and privacy policy may apply.

We may hold or delay payment to a Seller where reasonably necessary to:

  • confirm collection;

  • investigate a complaint;

  • resolve a payment dispute;

  • address a chargeback;

  • complete identity or anti-money-laundering checks;

  • comply with legal obligations; or

  • protect a Buyer, Seller or the platform from suspected fraud.

The Seller must not release an Item until payment has been confirmed through the agreed payment process.

A payment confirmation displayed by a Buyer is not sufficient where the Seller or Meubles Monaco has reason to believe that the confirmation may be inaccurate or fraudulent.

We may deduct our commission, refunds, chargebacks, payment-processing costs or other sums properly due to us before remitting the Seller’s proceeds.


15. Inspection and Condition of Items

Most Items offered through Meubles Monaco are second-hand.

Reasonable signs of age, prior use, wear, patina, fading, minor marks and historic repairs should be expected.

A Buyer should carefully:

  • read the complete Listing;

  • review all photographs;

  • request additional information where needed;

  • confirm dimensions and access requirements;

  • arrange a viewing where practicable; and

  • inspect the Item before or at collection.

A Buyer who collects an Item, or permits a removal company to collect it on their behalf, should inspect the Item before it leaves the Seller’s premises.

Acceptance at collection does not remove any mandatory rights that cannot legally be excluded, including rights relating to fraud, undisclosed defects or material misrepresentation.

No wording in these Terms excludes a Seller’s responsibility for making false or misleading statements.


16. Collection, Access and Removal

Unless expressly agreed otherwise, the Buyer is responsible for:

  • arranging collection;

  • selecting and instructing a suitable removal company;

  • measuring doors, lifts, corridors and access routes;

  • checking parking and building restrictions;

  • obtaining any required permissions;

  • dismantling, packaging, lifting and loading;

  • ensuring that personnel and equipment are suitable; and

  • paying all collection and transport costs.

The Seller must provide reasonable and accurate information concerning:

  • the collection address;

  • access restrictions;

  • stairs or lift access;

  • parking constraints;

  • collection times; and

  • any known specialist removal requirements.

The Buyer and Seller must agree collection arrangements directly or through Meubles Monaco.

If the Buyer fails to collect within the agreed period, the Seller or Meubles Monaco may:

  • agree a revised date;

  • charge reasonable storage or administrative costs where disclosed;

  • cancel the transaction;

  • retain amounts lawfully due; or

  • make the Item available to another Buyer.

The parties are responsible for ensuring that collection takes place safely and without damage to property.


17. Transport Providers

Meubles Monaco does not provide transport, removal, storage or installation services unless expressly agreed in writing.

We may supply contact information for independent transport providers as a convenience.

Any transport contract is entered into directly between the User and the transport provider.

We do not control and are not responsible for:

  • the provider’s availability;

  • pricing;

  • insurance;

  • qualifications;

  • conduct;

  • delays;

  • damage;

  • loss; or

  • performance.

Users should check that any provider has suitable insurance and experience before appointing them.

Unless the Seller has expressly agreed to arrange delivery, risk associated with the selected transporter rests with the party who appointed that transporter, subject to applicable law.


18. Ownership and Risk

Ownership of an Item transfers in accordance with the Sale Contract between the Buyer and Seller.

Unless mandatory law or a written agreement states otherwise, ownership will not transfer until the Seller has received cleared payment in full.

Risk of loss or damage will normally pass to the Buyer when:

  • the Buyer takes physical possession of the Item; or

  • a transporter appointed by the Buyer collects the Item.

Where a Professional Seller is legally responsible for delivery to a Consumer, mandatory consumer-law rules concerning risk will prevail.


19. Cancellations, Returns and Refunds

19.1 Private sales

Where a Private Seller sells an Item to a Buyer, the Buyer may not have an automatic right to cancel simply because the transaction was arranged online.

Subject to mandatory law, a private sale may be treated as final once the Item has been inspected, accepted and collected.

This does not affect rights arising from:

  • fraud;

  • misrepresentation;

  • lack of legal title;

  • an Item being materially different from its Listing; or

  • any right that cannot legally be excluded.

19.2 Professional sales

Where a Professional Seller sells to a Consumer, the Seller must provide all cancellation, withdrawal, guarantee and refund rights required by the law applicable to that transaction.

Depending on the circumstances, this may include a statutory withdrawal period for a distance sale, including where the Item is second-hand.

The identity and status of the Seller should be reviewed before purchase.

19.3 Material misrepresentation

A Buyer who believes an Item has been materially misrepresented must:

  • stop using or altering the Item;

  • retain the Item and all related evidence;

  • notify us and the Seller promptly;

  • provide photographs and a clear explanation; and

  • allow a reasonable opportunity for the issue to be investigated.

A difference will generally be material where it significantly affects the Item’s identity, authenticity, function, value or usability and was not reasonably apparent from the Listing or inspection.

Minor wear, variations in colour, ordinary signs of use or matters clearly disclosed in the Listing will not normally constitute material misrepresentation.

19.4 After collection

No voluntary return will normally be accepted after collection merely because:

  • the Item does not fit;

  • the Buyer no longer likes it;

  • the Buyer has changed their mind;

  • the colour differs slightly from its appearance on screen;

  • access was not properly measured; or

  • the cost of transport is higher than expected.

This clause does not restrict mandatory legal rights.


20. Disputes Between Buyers and Sellers

The Buyer and Seller should first attempt to resolve any dispute directly and reasonably.

Meubles Monaco may, but is not obliged to:

  • request evidence;

  • facilitate communications;

  • delay release of Seller funds;

  • propose a practical resolution;

  • refund a Reservation Payment;

  • suspend an account or Listing; or

  • refer the parties to an appropriate third party.

Any assistance we provide does not make us a party to the Sale Contract or require us to determine legal liability.

Users must cooperate honestly with any investigation and preserve relevant photographs, messages, invoices and collection records.

We may make an administrative decision concerning funds processed or held through the Website. That decision does not prevent either party from pursuing any legal rights directly against the other.


21. Off-Platform Transactions and Fee Avoidance

Users must not use information obtained through Meubles Monaco to avoid Platform Fees.

Prohibited conduct includes:

  • completing a sale privately after an introduction through the Website;

  • asking another User to cancel a reservation and pay directly;

  • disguising the purchase price;

  • exchanging contact details for the purpose of avoiding commission;

  • moving the transaction to another platform to avoid fees; or

  • arranging for a connected person or business to purchase the Item instead.

Where a sale is completed in breach of this section, Meubles Monaco may:

  • invoice the Seller for the commission that would have been payable;

  • recover reasonable enforcement costs where legally permitted;

  • suspend or terminate the User’s account;

  • remove Listings; and

  • take appropriate legal action.

This section continues to apply for six months after an introduction made through Meubles Monaco.


22. Reviews and User Content

Users may submit reviews, photographs, descriptions and other content.

By submitting content, you confirm that:

  • you own it or have permission to use it;

  • it is accurate and not misleading;

  • it does not infringe another person’s rights;

  • it is not defamatory, unlawful, abusive or discriminatory; and

  • it does not contain malicious software.

You grant Meubles Monaco a worldwide, non-exclusive, royalty-free licence to host, reproduce, edit, translate, publish and use that content for operating and promoting the Services.

We may remove User content where we reasonably believe that it breaches these Terms or applicable law.


23. Intellectual Property

The Website and its content, including its branding, layout, graphics, written content, logos, databases and software, are owned by or licensed to IFR Holdings Ltd.

Except where permitted by law, Users must not:

  • copy or reproduce Website content;

  • use our branding without permission;

  • scrape or extract Listings or data;

  • create a competing database;

  • modify or distribute our content; or

  • use photographs from the Website for another commercial purpose.

A Seller retains ownership of their original photographs and content but grants us the licence described in these Terms.


24. Verification, Anti-Money Laundering and Sanctions

We may carry out identity, ownership, payment, fraud, sanctions and other compliance checks.

We may request:

  • proof of identity;

  • proof of address;

  • business registration information;

  • evidence of ownership;

  • source-of-funds information;

  • banking information;

  • invoices or provenance records; and

  • any other information reasonably required for legal or risk-management purposes.

Users must provide accurate information and cooperate with reasonable requests.

We may refuse, suspend, delay or cancel a Listing, payment or transaction where:

  • requested information is not supplied;

  • the information cannot be verified;

  • suspicious activity is identified;

  • sanctions or other legal restrictions may apply; or

  • we are required or permitted to do so by law.

We may disclose information to payment providers, professional advisers, regulators, law-enforcement authorities or other appropriate parties where legally required or reasonably necessary.

We are not responsible for delay or loss resulting from a compliance check where we have acted reasonably and lawfully.


25. Taxes, Duties and Reporting

Each User is responsible for determining and meeting their own tax, customs, invoicing and reporting obligations arising from their use of the Services.

Professional Sellers are responsible for issuing any invoice or receipt required by law.

We may collect, retain or report transaction and User information where required by tax, marketplace-reporting or other legal obligations.

Nothing on the Website constitutes tax, customs or legal advice.


26. Availability of the Website

We aim to keep the Website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may:

  • carry out maintenance;

  • change or withdraw features;

  • correct errors;

  • suspend Services;

  • restrict access; or

  • discontinue all or part of the Website.

We are not liable for temporary unavailability caused by maintenance, technical failure or circumstances outside our reasonable control.


27. Disclaimer

To the fullest extent permitted by law, Meubles Monaco does not guarantee:

  • that an Item will sell;

  • the accuracy of information supplied by a User;

  • the identity or reliability of a User;

  • the condition, safety or authenticity of an Item;

  • the accuracy of an attribution or valuation;

  • the availability of transport;

  • completion of a transaction; or

  • that use of the Website will meet a User’s particular requirements.

Information provided through the Website is general marketplace information and should not be relied upon as professional valuation, authentication, legal, tax, insurance or transport advice.

Nothing in this section limits any responsibility that cannot lawfully be excluded.


28. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • deliberate misconduct;

  • breach of obligations that cannot legally be excluded; or

  • any other liability that applicable law does not permit us to exclude.

Subject to the above, Meubles Monaco is not responsible for loss arising from:

  • the acts or omissions of a Buyer, Seller or third party;

  • inaccurate information provided by a User;

  • the condition, ownership, authenticity or safety of an Item;

  • transport, removal, storage or installation;

  • a transaction that does not complete;

  • unauthorised access caused by a User’s failure to protect their login details;

  • events outside our reasonable control; or

  • business losses, including loss of profit, revenue, opportunity, goodwill or anticipated savings.

Where a User is a Business User, our total liability arising from a particular transaction or use of the Services will not exceed the greater of:

  • the Platform Fees paid to us in connection with that transaction; or

  • €250.

This financial cap does not apply where liability cannot legally be limited.

For Consumers, our liability will be limited only to the extent permitted by applicable consumer law.


29. Indemnity for Business Users

A Business User agrees to compensate IFR Holdings Ltd for reasonable losses, liabilities, claims and costs arising from:

  • the Business User’s breach of these Terms;

  • an unlawful or misleading Listing;

  • infringement of another person’s rights;

  • failure to meet tax or regulatory obligations; or

  • the sale of an Item that the Business User was not entitled to sell.

This section does not apply to Consumers to the extent that applying it would be unlawful or unfair.


30. Suspension and Termination

We may suspend or terminate access to the Services where a User:

  • materially or repeatedly breaches these Terms;

  • fails to pay fees;

  • engages in fraudulent or abusive conduct;

  • creates legal or safety risks;

  • fails compliance checks;

  • attempts to avoid commission; or

  • uses the Website unlawfully.

Where appropriate, we may provide reasons and an opportunity to respond.

Termination does not affect:

  • rights and liabilities accrued before termination;

  • outstanding payments;

  • commission due on an introduction already made; or

  • provisions intended to continue after termination.


31. Changes to These Terms

We may update these Terms to reflect changes to:

  • the Services;

  • our business practices;

  • technology;

  • legal or regulatory requirements; or

  • security and risk controls.

The updated version will be published on the Website with a revised “last updated” date.

Material changes will apply prospectively unless immediate application is legally required.

Continued use of the Services after the effective date of updated Terms constitutes acceptance of those Terms.

The Terms applicable to a particular transaction will ordinarily be those in force when that transaction was entered into.


32. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

A delay or failure by us to enforce a right does not waive that right.

Users may not transfer their rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations to another organisation, provided that doing so does not reduce any mandatory rights available to a Consumer.

These Terms, together with any policies expressly incorporated into them, constitute the agreement between the User and Meubles Monaco concerning use of the Services.


33. Governing Law and Jurisdiction

These Terms and the agreement between a User and IFR Holdings Ltd concerning the provision of the Meubles Monaco Services are governed by the laws of England and Wales.

If you are a Consumer resident in France, Monaco or another country, this choice of law does not deprive you of any mandatory consumer protection provided by the law that would otherwise apply to you.

A Consumer may bring proceedings in any court that has jurisdiction under applicable law. Nothing in these Terms requires a Consumer to bring a claim exclusively in England and Wales where mandatory law gives that Consumer the right to bring proceedings elsewhere.
